Judge Overturns Occupy NOLA Eviction by Shay Sokol (4:46 p.m.) CBD - After the city's early morning eviction of Occupy NOLA, this afternoon, U.S. District Judge Jay Zainey ruled in favor of the protestors, granting a 7-day temporary restraining order that would allow protesters to remain in Duncan Plaza at all hours of the day until next Tuesday. The ruling came almost five hours after lawyers for the City and the Occupy Wall Street offshoot entered the judge's chambers for a hearing on the matter at 10:30 this morning.
Zainey said parties did not reach a compromise on use of the Plaza, so he granted the temporary order.
He laid out several conditions for the protesters: They are prohibited from using open flames, any electrical cords, and they cannot carry weapons or have pets at the site. Two portable toilets also have to be kept at the site, and must be provided by the Occupiers. William Quigley, one of the three lawyers for the protestors has has already footed the bill to provide for the two toilets, allowing the protestors to move back to the park and stay overnight.
Duncan Plaza was cleared by NOPD officers this morning after two months of serving as an encampment for the protesters, as well as many homeless people and traveling kids. Following the lead of other cities around the country, Mayor Mitch decided it was "time" for the protesters to go. In a press conference last Friday, Landrieu declared an eviction at an uncertain, but imminent time, because "there is a time and place" to exercise the First Amendment.
Directly after the decision, Lawyer Bill Quigley addressed twenty protestors in the lobby of the Court House. "This is a victory for the First Amendment," he said.
One protestor yelled in the lobby, "Who dat say gonna evict Occupy NOLA!"
Another lawyer for the protestors, Davida Finger, advised the Occupiers to use this week deciding what to do after the next court hearing in seven days that will decide the permanent state of the park.
Zainey set a $5,000 security bond to be paid by the protestors. Lawyer Quigley said he has already secured the donations to pay it.
Quigley said this is the only Occupation in the country that had been evicted, then granted by a court a return. But there is no hope for the Occupiers to get their tents and belongings they left behind in the park when NOPD evicted them at 4:30a.m. this morning. By 6:30a.m., tents churned in grinders, spat into dumpsters, and drove off on trucks.
"The City is not happy, so you guys should go out of your way to follow the rules," Quigley advised the protestors.
"We respect the Court's decision, but we respectfully disagree," acting City Attorney Richard Coritzas said in a statement.
City defenders told the judge the City spent about $50,000 over the past eight weeks on maintenance related to Occupy NOLA.
"Today, we successfully cleaned the park, housed homeless individuals, and reduced the threats to public health and safety," the statement said. "We will comply with the order of the Court, but we remain deeply concerned that allowing the re-encampment of Duncan Plaza poses a threat to the public health, safety, and welfare of those encamped there and to the community at large."  ’)
